O/GS compensation
There are various schemes to help solve the childcare benefit problems. One of these schemes is the O/GS compensation. Below you can read who this scheme is meant for. And what the scheme entails.
What does O/GS mean?
O/GS means “Opzet of Grove Schuld” (wilful misconduct or gross negligence). This concerns people who have not provided the correct information to Toeslagen. For example, information about their income or about the cost of childcare. As a result, these people were wrongly denied a personal payment schedule.
Did you have to pay back money because you received too much childcare benefit? And have you been wrongly denied a personal payment schedule? In that case, the O/GS scheme offers compensation.
What are the consequences of the O/GS label?
- People who are given the O/GS label will be denied a personal payment scheme.
A personal payment scheme is an arrangement with the Dutch Tax and Customs Administration to pay off a tax or benefit debt. Someone with a personal payment scheme may pay off their debt in instalments. In doing so, the Dutch Tax and Customs Administration takes account of their financial situation. If there is still a debt outstanding after two years of repayment, it is usually waived.
Those who are given the O/GS label will not get such a scheme and must pay off their entire debt within two years. - The Dutch Tax and Customs Administration does not cooperate in debt restructuring procedures for people who are given the O/GS label.
For whom is the O/GS compensation meant?
This restoration scheme is meant for parents who rightly had to pay back money, but were wrongly accused of having engaged in wilful misconduct or gross negligence (O/GS). This often happened when they applied for a personal payment scheme or debt restructuring.
The Dutch Tax and Customs Administration believed that these parents had deliberately made mistakes in their childcare benefit applications. But often they had not made mistakes on purpose. For example, they had only forgotten to provide information.
As they were accused of having engaged in wilful misconduct or gross negligence, parents did not qualify for a personal payment scheme. They had to repay their entire debt within two years and got into financial difficulties as a result.
Some parents who fall under the compensation scheme or hardship scheme are also given the O/GS label. The O/GS compensation is not meant for these parents. For they are already eligible for the compensation scheme. This scheme is more favourable. The O/GS scheme is only meant for parents who rightly had to pay back money, but were wrongly given the O/GS label and were wrongly denied a personal payment schedule.
How is the O/GS compensation structured?
During the integrated assessment of your case, we assess what exactly happened. If you qualify for the O/GS compensation, we will look at how much childcare benefit you had to repay. Your compensation is 30% of that amount.
